Terms of Service

These Terms govern your use of Second Brain (the "Service"): the www.secondbrain.media website, the web app, the desktop and mobile apps, and the related APIs. By creating an account or using the Service, you accept these Terms.

1. What the Service is

Second Brain is a productivity workspace: daily notes, tasks and planning, documents, canvases, files, meeting recaps with transcription, a knowledge Atlas, and AI features that operate on that content.

You can use it on the web, from the macOS and Windows desktop apps, from the mobile app, and connect it to external AI clients over the MCP protocol.

We may add, change or discontinue features. If a discontinuation materially affects a paid plan, we give reasonable advance notice.

2. Your account

You need an account to use the Service and you must be at least 13 years old (or the minimum age your jurisdiction requires to give consent).

You are responsible for the information you register, for keeping your credentials confidential, and for all activity under your account. Tell us immediately about any unauthorized use.

3. Plans, pricing and billing

The free plan has no time limit. Paid plans are billed in advance, monthly and in USD, and renew automatically until you cancel. Current prices for every plan are published on the pricing page.

Prices may exclude taxes, withholdings or charges from your bank or card issuer, which are your responsibility.

If we change a plan price, we notify you before it applies to your next renewal. If you disagree, you can cancel before that date.

Cancellations, refunds and plan changes are governed by the Refund Policy.

4. Your content

The content you create or upload is yours. We claim no ownership over your notes, documents, files, canvases or recordings.

You grant us a limited, non-exclusive, revocable license to host, process, transmit and display that content for the sole purpose of operating the Service and delivering the features you use (for example, indexing it for search, transcribing a recap or generating a summary).

We do not sell your content, we do not use it for advertising, and we do not use it to train generalized AI models.

The Service uses AI models to extract tasks and entities, transcribe and translate meetings, interpret what is on screen, generate documents and answer in the assistant chat.

AI output can be wrong. It is not legal, medical, financial or professional advice. Review it before relying on it or sharing it.

To deliver these features, the necessary content is transmitted to model providers acting as processors, under our instructions and without using it to train generalized models. Details are in the Privacy Policy.

7. Meeting recording (Recaps)

Recaps can capture audio from your microphone or system output and take screenshots for screen comprehension.

You are responsible for complying with applicable law and for obtaining consent from other participants where your jurisdiction requires it before recording, transcribing or capturing a meeting.

8. Third-party integrations

Integrations are optional: we only access a connected service after you explicitly authorize it, we use that data solely for the corresponding feature, and you can disconnect at any time, which revokes our access.

Each connected service is also governed by its own terms. We are not responsible for its availability or for changes to its APIs.

9. Workspaces and collaboration

A workspace can have several members. Whoever administers it can invite and remove people, and set edit or view-only permissions on documents and their trees.

If you share content with other users, they will be able to see it —and edit it, depending on the permissions you grant— in their own workspace. Only share what you have the right to share.

10. Availability and support

We work to keep the Service available, but interruptions can happen due to maintenance, incidents or third-party failures. The free plan is provided without a service-level commitment.

11. Suspension and termination

You can cancel your subscription or delete your account at any time from the app.

We may suspend or close an account that breaches these Terms, creates a security risk, or where the law requires it. Except in serious cases or where legally prevented, we notify you first and give you the chance to export your content. After termination, content is deleted within 30 days, as described in the Privacy Policy.

12. Intellectual property

The Second Brain software, brand, design and documentation belong to Second Brain or its licensors. These Terms transfer no rights over them beyond your use of the Service.

13. Disclaimers and limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and error-free operation.

To the maximum extent permitted by law, our total aggregate liability for any claim related to the Service will not exceed the amount you paid in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect damages, lost profits or data loss you could avoid by keeping your own backups.

Nothing in these Terms limits rights that your local consumer law treats as non-waivable.

14. Changes to these Terms

We may update these Terms. Material changes are communicated in the app or by email and reflected in the "Last updated" date. If you keep using the Service after that date, you accept them.

15. Governing law and contact

These Terms are governed by the laws of Argentina, and any dispute is submitted to the ordinary courts of the City of Buenos Aires, without prejudice to the venues that consumer protection rules reserve for the user.
